No claim to genetic testing OFA and elbow radiographs, or hereditary eye disease of the parents has been performed or claim made to it.

 

Purchase price

The purchase price of this puppy is _____________. Breeding rights are NOT automatically sold with any puppy. The price may vary for a puppy with breeding rights and a “Breeding rights addendum” must be signed.

A non-refundable deposit in the amount of $300.00 is required to “hold” the puppy until it is 6-8 weeks old and ready to relocate to it’s new home. The held deposit will be deducted from the purchase price of the puppy, with the remaining balance to be paid to WMK in cash or via PayPal on delivery of said puppy.

UNDER NO CIRCUMSTANCES WILL THE DEPOSIT BE REFUNDED IF BUYER CHANGES THEIR MIND AND DECIDES NOT TO PURCHASE THE PUPPY. 

If desired color and sex of puppy is not produced, then the deposit will be completely refunded.

Delivery Date

The puppy will be available for Buyer pick-up (physically remove from WMK kennel residence) on _________________. This date is based on our estimation of when the puppy will be naturally weaned and ready to leave. All of our puppies stay with us for a minimum of six weeks.

If the seller has not contacted WMK within five (5) days of the scheduled pickup date, the seller has the right to either put the puppy back up for sale, or charge the Buyer $50.00 a week in boarding fees. If the Buyer defaults on the scheduled pickup date, the Buyer forfeits all deposit money. Seller/Buyer’s are allowed to change the pickup date as long as the Buyer/Seller gives 24 hour notice.

 

Health Agreement and Guarantee

The Seller assumes no responsibility for this dog after it leaves sellers premises due to: Purchaser’s landlord’s disapproval, allergies to the dog, or because of a family disagreement or other change of heart

This puppy is guaranteed healthy at the time of sale, with the exceptions of internal parasites or fleas.

***Buyer has 72 hours to take the puppy to their veterinarian for a wellness exam. If Buyer fails to do so, the healthy guarantee is void. By signing this contract, the Buyer waves the health guarantee if puppy is not examined within the initial seventy-two hours.

***Buyer also understands if the puppy is not brought to a veterinarian within the first 72 hours of Buyer’s possession, than no refunds, reimbursements, or health guarantee will be honored. Buyer is responsible for making an appointment ahead of time with their veterinarian so that the 72 hour puppy wellness exam requirement can be met. This means, phone your veterinarian and set up the appointment at least two weeks prior to picking up your puppy.

Should the owner notice any abnormalities in their puppy before the initial seventy-two hours veterinary health examination, please notify us immediately.

Buyer is financially responsible for the first office visit, deworming, fecal exams, vaccines, and any other treatment once in the buyer’s care. The health and wellbeing of your puppy/dog depends on the quality of care you as the Buyer provide. It is extremely important to take your puppy to the veterinarian every three weeks for a series of three additional distemper/parvo vaccines. Rabies vaccine can be given at 12-16 weeks depending on what state you live in. Monthly Flea and Heartworm preventative is also advised. Buyer is responsible for any and all medical treatment the puppy requires at the veterinary visits.

If the buyer’s veterinarian finds a LIFE THREATENING AND INCURABLE CONGENTICAL HEALTH PROBLEM EXCLUDING COMMON PUPPY ISSUES LIKE: hypoglycemia, coccidiosis, mange, giardia, or intestinal worms, prior to the puppy reaching one year of age, the seller must be informed in writing from the buyer. A written report from the examining veterinarian, along with a diagnosis, medical records, radiographs, ultrasound reports, and any other ancillary testing must also be provided to the seller at that time. The seller’s veterinarian must also concur that the puppy’s diagnosis is a life threatening incurable congenital defect and that it EXISTED at the time of purchase. If the Seller’s veterinarian agrees with the diagnosis of an incurable congenital defect, then the purchaser will have the option of a replacement puppy.

If DEATH occurs within the first six months, a necropsy must be performed by a licensed veterinarian to determine the cause of death AT THE PURCHASER’S EXPENSE. If the cause of death is due to a congenital issue, a replacement puppy will be issued.

Common puppy problems that occur which are either treatable, curable, or non-life threatening are NOT warranted under this guarantee. If your puppy checks out healthy at the initially required veterinary visit, then that is the limit of WMK’s guarantee unless a congenital is diagnosed at a further date. In which case a replacement puppy will be provided.. Mishandling the puppy during deliver, transport, or improper care by the Buyer is the Buyer’s responsibility. Other than the preceding guarantee, the seller assumes no responsibility for the puppies once they leave WMK’s premise. Your puppy can become stressed by shipping, adjusting to a new home, different handling techniques, or changing diets and these could increase the likelihood of hypoglycemia, coccidiosis, and shedding of intestinal worms.

**** AT NO TIME will/does WMK provide monetary refunds, reimbursements, or assume responsibility for buyer’s veterinary bills. If, however, a congenital deformity is diagnosed at any time, a replacement puppy will be provided. WMK will not be responsible for any incurred veterinary expenses, surgical or medical unless prior consent between buyer and seller has been approved in writing.

Size and personality

The Seller will estimate the size, personality, and color of the puppy as accurately as possible. Because there are many factors involved in genetics and coat color, the breeder cannot one hundred-percent guarantee those traits. Seller also doesn’t warranty the genetics or breeding potential of any puppy. Nor does the seller guarantee a puppy’s temperament. All of our puppies are raised in our home and have stable personalities when they leave our facility. We provide daily socialization with humans and canines when old enough. After the Buyer is in possession of a puppy, it is their responsibility to keep the dog well socialized with people and other animals.

Vaccinations

Buyer agrees to keep the puppy healthy and stay current on all vaccines and procedures recommended by their veterinarian. Should the Buyer not follow any recommendations by their veterinarian, the healthy guarantee is void.

Puppies require a minimum series of four distemper/parvo vaccinations FROM A VETERINARIAN. The vaccine, commonly described by a veterinarian as a DHPP OR DHLPP, should be given starting at 6-8 weeks and then be given every three weeks thereafter. If the puppy starts vaccines at 6 weeks, getting the second vaccine at 8 weeks (instead of waiting 3 weeks) is highly recommended because maternal antibody may still be slightly present at six weeks, thus nullifying the 6 wk old vaccine. This puppy would then receive a total of 5 dhlpp or dhpp vaccines. The (L), “leptospirosis” is often omitted from the first initial vaccine. A rabies vaccine is usually given between 12-16 weeks old,depending on the State you live in. A minimum of three to four stool samples should be checked by your veterinarian for the presence of intestinal parasites. Heartworm and flea preventative pills should be given monthly and these must also be obtained froma a veterinarian. DON’T BE FOOLED BY KNOCKOFF VERSIONS YOU MAY PURCHASE OVER THE INTERNET.

Spay/Neuter

Based on new studies, it is now recommended that “Giant” dog breeds not be spayed or neutered until they reach two years of age. Studies have shown that removing the estrogen/testosterone sourced at an early age by surgically “altering” the animal early can change the angles of the stifle (knee), thus promoting an unwanted tear of the cranial cruciate ligament.

WMK understands it is difficult to keep a giant dog “intact” (unaltered) for two years, so we are recommending at the very least waiting until the one year mark. Giant dog breeds tend not to come into heat the first time until 8-12 months, but some dogs have become receptive as early as 5 months.

Purchaser warrants that the puppy/dog, which is the subject of this agreement is being purchased for the intended use a s a domestic pet and that the purchaser is not a breeder, exhibitor, dealer, animal testing facility, or a pet store as defined by federal law.

Breeding Rights

THIS PUPPY IS NOT BEING SOLD WITH BREEDING RIGHTS. If you choose to later purchase breeding rights, please contact Whisper Meadow Kennels for instructions on how to purchase them.

General:

The following statements apply to all Buyers of WMK puppies:

-Should the Buyer be unable or unwilling to fulfill any of the above provisions, or if this dog is seized by a local authority as having been neglected or abandoned, the Seller retains the right to reclaim this dog without compensation to the purchaser.

-The Buyer agrees to pay the Seller any and all expenses, including court costs and reasonable attorney fees in enforcing the terms and provisions of this contract. Canines are livestock and therefore cannot be returned for any reason other than those stipulated in the health agreement or additional terms and provisions sections of this contract.

-This agreement shall be governed by and construed in accordance with the laws of whatever county Seller currently resides in without regard to such jurisdictions conflict laws principles. Buyers and Seller submit to the jurisdiction of any state or federal court sitting in whatever county Seller currently lives in, in any action proceeding arising out of or relating to this agreement and agree that all claims in respect of the action or proceeding may be held and determined in any such court. Buyer’s and Seller also agree not to bring any action or proceeding arising out of or relating to this agreement in any other court. Buyers and Seller waive any defense of inconvenience forum to maintenance of any action or proceeding so brought and waive any bond, surety or other security that might be required of any other party with respect there to. Buyer and Seller agree that the final judgement in any action of proceeding so brought shall be conclusive (subject to any right of appeal) maybe enforced by the suit on the judgement or in any other manner provided by law or at equity. Buyer’s will be responsible for any and all court fees and lawyer fees for both parties even if the judge grans a decision upon their behalf. Maximum amount of refund that shall be awarded is the purchase price of the puppy less the non-refundable deposit. The parties intend this written contract as the final expression of their agreement and as a complete exclusive statement of the terms of their agreement. Should there be any disagreement, termination of said contract, refusal of sale, unpleasant experience or issues between the buyer and/or the Seller, there will be a no defamation of character/slander agreement. No party has the right to post on social media, internet site, newspaper, email, organization, or any personal page to slander the name of the Buyer or the Seller. Should the Seller need to seek legal action against the Buyer for violations of this agreement, the Buyer will assume any and all attorney costs and court fees.

Puppy is warranted ONLY for the purpose of being a companion animal and as a family pet. Although capable of performing other functions, such as show, breeding, or agility, no warranty is being given as to the level of these functions.

By signing my name below, I acknowledge that I have read and received copies of this contract including health records. By also signing below, I acknowledge that I did indeed purchase a puppy from Whisper Meadow Kennels.

Any payment returns, such as “bad checks,” PayPal or credit card reversals will find the purchaser still responsible for the above amount. Any FUNDS backed out/removed due to PayPal or credit card fee associated with the above will be the responsibility of the Buyer and will be due before the puppy leaves WMK.

By purchasing and taking home this puppy, you have agreed to the terms and conditions of this health guarantee and contract even if you do not sign or fill out this contract. All parties agree that this is an electronic signature and can still be represented in a court as an actual written signature.

No part of this contract may be declined, crossed out, or deleted. If in doubt, contract shall be reverted to current Whisper Meadow Kennel’s contract.

This agreement, made __________________ (date) between the breeder/seller and the buyer(s), is an enforceable and binding contractual agreement.
